Privacy statement users of digital services Talpa Studios

1. Controller

This Privacy Statement provides information and applies to all processing of personal data of users of digital services (hereinafter: “Users of Digital Services”), including but not limited to websites, apps, and social media accounts such as Instagram, Facebook, TikTok, YouTube, etc. (hereinafter: “Digital Services”), as operated by Talpa Studios Holding B.V. and its affiliated companies Talpa Studios Netherlands B.V. and Talpa Studios Concepts B.V., whereby Talpa Studios Holding B.V. is the controller. Talpa Studios Holding B.V. is located at Bergweg 70, 1217 SC Hilversum, the Netherlands and is registered with the Dutch Trade Register under number 77937376 (hereinafter: “Talpa Studios”, “us” or “we”).

By “processing” we mean all use of your personal data when you use our Digital Services, such as storing, modifying, transmitting, deleting and/or moderating this data. Talpa Studios respects your privacy and handles your data with care, processing it in accordance with applicable privacy legislation.

Please note: when using our social media platforms, the privacy statements and user terms of those platforms also apply. Talpa Studios has no control over how these third parties handle your personal data. We recommend that you read the terms of the relevant platform carefully.

 

 2. Minors

Are you under 16 years of age? If so, you may only provide us with personal data if your parents or legal guardians have read this Privacy Statement and have given their consent. This only applies if consent is the legal basis for processing (see section 6 below ‘Legal grounds for processing’). We cannot always verify whether someone is actually older than 16. To help prevent the processing of personal data of minors without parental consent, we advise parents or legal guardians to be involved in their children’s online activities.

 

3. Types of data

We process the following data for the purposes described in this Privacy Statement:

  • Name, address, and place of residence;
  • Age, gender, relationship status, education;
  • Contact details, such as (mobile) phone number and email address;
  • Photos, such as portraits or other photos in which you are recognizable;
  • Profile name (nickname) and profile photo or avatar;
  • Detailed (technical) data, such as device type and characteristics, browser type and language, date and time of interaction, and IP address;
  • Location data, such as GPS coordinates and/or geolocation derived from your IP address;
  • Search terms;
  • Data you share with us in comments on posts published by or on behalf of us on our social media channels and websites.

 

4. Source of data

We primarily collect your data by requesting it from you. You choose whether to provide this data. For instance, when filling in forms on our Digital Services. For certain services, some data must be provided before you can use the service, such as your name, email address and age when registering for an app linked to one of our television programmes. We indicate which fields are mandatory and which are optional.

We also obtain data via cookies and similar techniques. We only use cookies that are strictly necessary.

 

5. Purposes of processing

We process your data to provide and improve our services and Digital Services, such as:

  • To allow you to post and exchange information via our Digital Services, and (where applicable) interact with other users;
  • To send you user information, push notifications, and service messages (by phone or email);
  • To analyse, maintain, secure, fix and optimise our Digital Services and underlying technologies;
  • To facilitate your participation in contests and administer them;
  • To compile statistics to optimise our Digital Services and content effectiveness;
  • To send you (electronic) commercial messages from our programme advertisers and sponsors, including offers and prizes from these partners;
  • To measure the effectiveness of our electronic messages, including delivery and open/click rates;
  • To enable easy content sharing on social networks;
  • To monitor and moderate user-generated content on our Digital Services and social media, and remove such content if needed;
  • For internal analysis and reporting purposes, including anonymised reporting to partners;
  • To comply with applicable laws and regulations, such as verifying your age or fulfilling your data subject rights (see also section 9 below ‘Your rights’).

 

6. Legal grounds for processing

We process your personal data based on one of the following legal grounds:

  • Your consent: We process your data if you have given consent for a specific purpose, such as account creation or the use of non-essential cookies or commercial communications;
  • Legitimate interests: We process data based on our or a third party’s legitimate interests, for example, to secure our Digital Services or to inform you about similar services. We will always weigh these interests against your privacy rights.

7. Data retention and security

We do not retain your data longer than necessary for the purposes described. The exact retention period depends on the specific processing purpose.

Regarding Digital Services use, we retain your data for as long as you use our (account) services and up to two (2) years after your last login. This ensures continuity if you reactivate your use. If inactive for a long period, we will notify you before deleting your data unless you object.

In some cases, we may be legally required to retain your data for a longer period.

We protect your data through organisational and technical security measures appropriate to the state of the art, to prevent unauthorised access, modification, disclosure or loss.

 

8. Sharing of your personal data

Your data may be shared within Talpa Studios. We also engage third parties to process personal data on our behalf. These include:

  • Platforms allowing social media content sharing. These may collect information such as your IP address, geolocation from your IP, the URL being shared, and the time and date of access;
  • Commercial partners such as broadcasters or sponsors of our programmes, including for joint promotions;
  • Service providers and software suppliers who help us deliver services or provide you with prizes;
  • In the event of reorganisation, merger, sale, collaboration, or other business transfers (including bankruptcy);
  • Where required by lawful requests from public authorities, such as law enforcement or judicial bodies.

Where possible, we require these third parties to act as processors, bound by our instructions and standards through a data processing agreement.

Some processors are located outside the EU. In those cases, we take appropriate safeguards, such as concluding the European Commission’s standard contractual clauses.

If a party processes your data as a separate (joint) controller, we will inform you and refer to that party’s privacy statement.

 

9. Data subject rights

You have the right to access, rectify, delete or transfer your personal data. You also have the right to restrict or object to processing.

To exercise your rights, please email us at: privacy@talpastudios.com, with the subject: “Execution of rights Digital Services users Talpa Studios”. Please clearly state which personal data your request concerns and which right you wish to exercise.

We shall verify your identity and respond within one month. If the request is complex, we may extend this by up to two months and will inform you accordingly. We may ask for clarification and suspend processing your request until we receive it.

If we cannot comply with your deletion request in full due to legal obligations, we will inform you.

You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
